Who Handles Hempstead County Sex Offender Registration

The Hempstead County Sheriff's Office in Hope is the local agency responsible for registering sex offenders. Any person required to register who lives in Hempstead County must report to the Sheriff's Office to complete registration. The office uses the CENSOR system to process registrations electronically and submit data directly to ACIC. Registration Requirements for Hempstead County Sex Offenders

Any person convicted of a qualifying sex offense must register in Hempstead County if that is where they live, work, or attend school. Ark. Code Ann. § 12-12-901 et seq. covers all qualifying offenses, including rape, sexual assault in the first through fourth degrees, sexual indecency with a child, computer child pornography, internet stalking of a child, and more. The list has more than fifteen specific offenses and the law has been amended to add stricter requirements since it first passed in 1997.

Offenders arriving in Hempstead County from another state must register within three business days of establishing residency. People released from prison or moving from another county face the same deadline. Required documents include valid ID, proof of residence, court sentencing papers, all vehicle details, and every online account and screen name. Missing the three-day window is a separate felony charge.

Nonresident workers and students are not exempt. Anyone working or attending school in Hempstead County for more than fourteen consecutive days, or thirty total days in a year, must register with the Sheriff's Office in that county. This rule applies regardless of where the person lives.

Hempstead County Sex Offender Risk Levels

Each registered sex offender in Hempstead County is assigned one of four risk levels by SOSRA, the Sex Offender Screening and Risk Assessment unit. SOSRA is at 2403 E. The assessment includes a review of criminal history, a recorded interview, and may involve a polygraph examination or psychological testing. The assigned level controls how often the person must report and how widely the community is notified.

Arkansas defines each risk tier under the community notification rules that implement Megan's Law. Level 1 is low risk. No prior history of sexual acting out, no predatory patterns. Level 1 offenders are not shown on the public registry. Level 2 is moderate risk. Law enforcement has discretion to notify schools and nearby organizations. Level 3 is high risk with repeat history or predatory traits. Direct community notification is required, including face-to-face contact with neighbors and printed fact sheets. Level 4 is sexually violent predator status, triggering potential media alerts, public meetings, and posters.

Any offender who skips their SOSRA interview or refuses to cooperate is automatically assigned Level 3 or referred for Level 4 review. Avoiding the process does not avoid classification. Reassessment is available five years after the original, but the offender pays and must submit to a polygraph.

Risk level determines where a Hempstead County sex offender can live, how often they check in at the Sheriff's Office, and the scope of community notification.

Residency Restrictions in Hempstead County

Level 3 and Level 4 sex offenders in Hempstead County cannot live within 2,000 feet of any public or private elementary or secondary school or daycare facility. The Eighth Circuit upheld this restriction in Weems v. Little Rock Police Department, ruling it does not violate any fundamental right. The 2,000-foot buffer runs from the property line of the school or daycare, not the building. The rule applies throughout the county, including in Hope.

A limited exception covers offenders who owned and occupied a home before the school or daycare opened, or before July 16, 2003. That exception is permanently lost if the offender commits any new qualifying offense after that date. Violating the restriction is a Class D felony. Level 1 and Level 2 offenders are not subject to the 2,000-foot rule.

Note: Level 3 and Level 4 sex offenders in Hempstead County must maintain at least 2,000 feet from any school or daycare. Violation is a Class D felony under Ark. Code § 5-14-128.

Verification and Check-In for Hempstead County Offenders

Registered sex offenders in Hempstead County must appear in person at the Sheriff's Office on a schedule based on risk level. Level 1, Level 2, and Level 3 offenders report every six months. Level 4 sexually violent predators must appear every three months. These are mandatory visits. Missing a scheduled check-in can result in felony charges.

At each visit, officers update any changed information and take a new photo. The photo is sent directly to the public registry through the CENSOR system. Officers verify the current address, vehicle, and employment details. Any change since the last visit must be reported and updated in the state database right away. The Sheriff's Office may also conduct unannounced address verification checks between scheduled visits.

Planned address changes require ten days advance notice to ACIC and the Sheriff's Office. Emergency moves must be reported within three days. Name changes must be reported within five calendar days. Each missed notification is a separate Class C felony charge under Arkansas law. Failing to register, missing verification appointments, and providing false information are all treated as serious violations.

Removing a Name from the Hempstead County Sex Offender Registry

Some sex offenders registered in Hempstead County can petition for removal after meeting specific requirements. Under Ark. Code Ann. § 12-12-919, a petition cannot be filed until fifteen years after release from prison or the start of probation or parole. The court must find the person has committed no new sex offense during that period and does not pose a public safety threat.
