Verification and Check-In Schedule
Level 1, 2, and 3 sex offenders in Pulaski County must check in with their registering law enforcement agency every six months. Level 4 offenders must check in every three months. Offenders who owned and occupied their home before a nearby school or daycare opened, or before July 16, 2003, have a limited exemption. That exemption is lost if a new sex offense occurs after those dates. Violating the residency restriction is a Class D felony. Level 1 and Level 2 offenders are not subject to the 2,000-foot rule.
Terminating Registration Requirements
Some Pulaski County registrants may petition to end their registration after fifteen years from release or the start of parole or probation. Under Ark. Code Ann. § 12-12-919, the petition goes to the court, with copies to the prosecuting attorney, ACIC, and the community notification unit, at least thirty days before any hearing. Victims in the VINE system are automatically notified.
The court looks at whether the offender has stayed conviction-free for all fifteen years and whether they still pose any risk.
