A new photo is taken and uploaded to the ACIC database. Fingerprints and a DNA sample are collected at this first visit.

Risk Levels for Newton County Sex Offenders

These offenders have limited prior history. Schools may be notified at the discretion of local law enforcement. Level 3 is high risk. These offenders have repeat offense patterns or strong predatory traits. Notification is broad, including face-to-face contact with neighbors and direct outreach to schools and other organizations near the offender's home. Level 4 is sexually violent predator. This is the top classification. Notification can include media alerts and community meetings. The public is notified wherever the offender lives, works, or travels.

A Newton County offender who refuses the SOSRA assessment gets a default Level 3 assignment. The case may also be referred for Level 4 review. Skipping the interview does not protect you from a high risk level. It often guarantees one.

Note: Newton County sex offenders assigned Level 4 must check in at the Sheriff's Office every three months instead of every six months.

Level 3 and Level 4 sex offenders in Newton County are barred from living within 2,000 feet of any public or private elementary or secondary school or licensed daycare. The Eighth Circuit upheld Arkansas's residency restriction in Weems v. Little Rock Police Department. Violating the buffer zone is a Class D felony under Arkansas law.

Newton County Sex Offender Registry Removal
