Who Must Register in Jackson County

The Arkansas Sex Offender Registration Act, Ark. Code Ann. § 12-12-901 et seq., sets out every offense that requires registration. The covered crimes include rape, sexual assault in the first through fourth degrees, sexual indecency with a child, indecent exposure as a felony, computer child pornography, internet stalking of a child, video voyeurism as a felony, and more than ten additional offenses. The list has been expanded several times since the law passed in 1997.

People who move to Jackson County from another state must register with the Sheriff's Office within three business days of establishing residency. That same three-day window applies to offenders released from the Arkansas Department of Correction who return to Jackson County. Weekends count. The deadline does not pause for weekends or holidays. Out-of-state workers and students who spend more than fourteen consecutive days or more than thirty total days per year in Jackson County must also register, even without Arkansas residency. They register at the Sheriff's Office in the county where the job or school is.

Sex Offender Risk Levels in Jackson County

SOSRA, the Sex Offender Screening and Risk Assessment unit, assigns a risk level to every registered sex offender in Jackson County. SOSRA is based at 2403 E. The assessment process includes a review of the offender's criminal history, a personal interview, potential polygraph or voice stress testing, and psychological evaluation tools when needed. The assigned level determines how often the offender must check in and what information is shared publicly.

Arkansas defines four risk levels under its sex offender notification regulations. Level 1 is low risk. No meaningful prior history of sexual acting out and no strong antisocial tendencies. Not shown on the public website. Level 2 is moderate risk. Limited prior history with mild predatory patterns. Schools and nearby organizations may be notified at the Sheriff's discretion. Level 3 is high risk. Repeat offense history or strong predatory behavior. Broad community notification is required. Level 4 is sexually violent predator, the highest tier. Offenders who skip the SOSRA interview or refuse to cooperate are assigned a default Level 3 or sent for Level 4 review. Avoiding the process does not lower the risk classification. Reassessment can be requested five years after the original assessment, but the offender must pay the cost and complete a polygraph examination.

Residency Limits and Reporting Rules in Jackson County

Level 3 and Level 4 sex offenders in Jackson County are barred from living within 2,000 feet of any public or private elementary or secondary school or daycare facility. The Eighth Circuit Court upheld these restrictions, finding no violation of fundamental rights. The buffer is measured from the property boundary of the school or daycare, not just the building itself. In a county with rural roads and scattered facilities, that 2,000-foot zone can cut across a larger area than offenders expect.

A limited exception applies to offenders who owned and lived in their home before July 16, 2003, or before the school or daycare opened. That exception vanishes if the offender commits any new qualifying sex offense after the relevant date. Violating the residency restriction is a Class D felony. Level 1 and Level 2 offenders are not subject to the 2,000-foot rule. The restriction only applies to the two highest risk tiers.

All registrants must verify in person on schedule. Level 1, 2, and 3 offenders check in every six months. Level 4 offenders check in every three months. Address changes must be reported ten days before the move. Emergency relocations caused by fire or disaster must be reported within three days. Missing any deadline or providing false information is a Class C felony, punishable by three to ten years in prison and up to $10,000 in fines.

Jackson County Community Notification

When a sex offender registers in Jackson County, the Sheriff's Office decides how broadly to notify the community based on the assigned risk level. Level 1 notification is narrow. Only law enforcement and adults in the same household as the offender are told. Level 2 notification may extend to schools and organizations that work with people likely to encounter the offender. The Sheriff's Office has discretion on how far to take Level 2 notification.

Level 3 notification requires direct outreach. Neighbors are visited in person. Schools, community groups, and other nearby organizations receive notice. The Offender Fact Sheet distributed to community members includes the offender's name, aliases, current photo, physical description, address, vehicle, criminal history, and the factors that shaped the risk level assignment. Details such as Social Security numbers and employer information are not included in the public-facing sheet. Recipients are advised to keep the information within the specified group and not share it widely.

Level 4 notification is the widest available. The Sheriff's Office can hold public meetings, post flyers, and work with local media outlets to inform Jackson County residents. Under Ark. Code Ann. § 12-12-913, public officials and law enforcement who act in good faith during the notification process are shielded from civil liability unless their conduct rises to gross negligence or bad faith.
